This Privacy Policy was adopted to demonstrate our commitment to protecting the personal information you provide to us during contests and other promotions that we sponsor (collectively, “contests”) and during your interactions with our websites, which include ClarksCanada.com and any website(s) used for contest administration purposes (collectively, “Sites”). Clarks will only collect personal information about you if you provide it to us voluntarily.
When you elect to participate in one of our contests, you must consent to our collection, use, and disclosure of your personal information for contest administration and prize notification purposes. Clarks may also use your information to provide you with direct and/or email marketing communications about our products, if you explicitly consent to such communications. Joining our direct or email marketing list will never be a requirement for entering or participating in a contest.
THIRD PARTIES AND YOUR INFORMATION
Clarks will not share your personal information with third parties without your consent, except: (i) in accordance with the terms of this Privacy Policy, (ii) where it is required by law, and (iii) as necessary for business operation or contest administration purposes.
When Clarks works with third parties who require access to your personal information for business operation or contest administration purposes, for example in instances where we use a third party to host a contest website or select a contest winner, we require that they handle your information with the utmost confidentiality and care and use it solely for the business purpose for which it was intended. Clarks carefully selects reputable business partners who exhibit our same high level of commitment to protecting your personal privacy.

Keeping your personal information confidential and secure is important to Clarks. We have implemented certain procedures in order to protect the personal information you provide to us from unauthorized access and improper use, and we will continue to update those procedures as appropriate.
RETENTION
Clarks will retain your personal information only for the period of time necessary to fulfill the purposes outlined in this Policy, unless a longer retention period is required by law.
MAIL COMMUNICATIONS AND YOUR CHOICES
Some of our contests give you the option of joining our email and/or direct mail marketing lists. If you elect to join our email and/or direct mail marketing list and later desire to no longer receive such communications, you may unsubscribe at any time. To unsubscribe from our email marketing list, either: (i) click on the “unsubscribe” hyperlink contained in all of the marketing emails we send to you, or (ii) send an email to customerservice.questions@clarksna.com with “Email Removal-Canada” in the tag line, and your name and email address in the body of the email. To unsubscribe from our direct mail marketing list, either: (i) call Consumer Services at (800) 563-1825, (ii) send an email to customerservice.questions@clarksna.com with “Direct Mail Removal - Canada” in the tag line, and your name and address in the body of the email, or (iii) send a letter, inclusive of your name and address, stating that you no longer wish to receive direct marketing mail to: C & J Clark Canada, Ltd., Attn: Marketing, 2881 Brighton Road, Oakville, Ontario L6H 6C9.
Removal from either mailing list may take up to ten (10) business days from the time your request is received, during which time you may continue to receive applicable mail correspondence from Clarks.
COOKIES
Clarks may use cookies in connection with our Sites. Cookies are small data files that are downloaded onto your computer when you visit a particular website. Any use of cookies on our Sites will be for contest administration purposes and not to collect any personal information about you. While most browsers automatically accept cookies, you can change the settings on your browser to notify you when you receive a cookie or to decline the acceptance of any cookies. If you decline to accept cookies, however, your ability to properly submit an online entry may be affected in certain instances.
CHILDREN
Clarks does not knowingly solicit or collect personal information from children. In instances where we obtain knowledge that a child has submitted personal information to us, we will delete such information as soon as possible.
SITE CONTENT
The content found on our Sites, including without limitation any logos, designs, text, pictures or trademarks, may be subject to copyright and other intellectual property rights. All content is provided solely for your personal and non-commercial use. Any commercial or derivative use of our Sites is strictly prohibited, and this includes without limitation the distribution, modification, publication, sale or public display of any content obtained from our Sites.
INTERNATIONAL USERS/CHOICE OF LAW
Our Sites are intended to be used by Canadian residents only. Clarks does not represent or warrant that the materials found on our Sites are appropriate for use outside of Canada. In the event you choose to access our Sites from outside of Canada, you do so on your own accord and in full recognition of any local laws, regulations, or restrictions that may apply. Any dispute arising out of the use of our Sites will be governed by the laws of the Province of Ontario and the applicable federal laws of Canada. In the event any condition of this Policy is deemed to be illegal, void or unenforceable, the remainder of this Policy shall remain fully operative.

Clarks expressly disclaims all warranties, whether express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose, and any warranties of title or non-infringement. Clarks does not represent or warrant that our Sites, or their function, downloadable materials, contents or any services that they herein provide, will be uninterrupted, error-free, virus-free, accurate, secure, complete, satisfactory, or cured of any defects. Clarks is not responsible for any damages incurred as a result of your use of our Sites, as your visitation and use of our Sites is done at your own risk. In the event your jurisdiction does not allow for a disclaimer of implied warranties, the abovementioned disclaimer may not apply to you.
LIMITATION OF LIABILITY
You assume all responsibility and risk associated with your entry into a contest and use of our Sites. Under no circumstances will Clarks, or any of its directors, employees, or agents, including any party involved in the creation, hosting, or delivery of our Sites, be liable for any consequential, indirect, special, incidental, or punitive damages related to your entry into a contest or the use of our Sites or any linked websites, including but not limited to any lost profits or revenues, anticipated profits or revenues, lost data or business opportunities, damages arising out of any defects, malfunctions, or other performance-related failures of our Sites, personal injuries to you or any third party, or any other tangible or intangible losses or damages. Your lone remedy in response to any discontent with our Sites is to stop accessing our Sites. Any claim or cause of action arising out of or related to your use of our Sites must be commenced within one (1) year from the time the claim or cause of action transpires, or such claim or cause of action is permanently and forever forfeited.
